Gift Aid – Agency Agreement

Dear Donor,
 
Thank you for bringing your goods to RSPCA Stort Valley Branch for sale.
Due to an administrative error, the agency agreement was missing when you signed up with RSPCA Stort Valley Branch as a gift aider. As a result of this, we are contacting you to advise you of the agency agreement. Please contact us within 21 days of receipt of this notice/letter, either by email giftaid@rspcastortvalley.org.uk or by post to: 2, The Dells, South Street, Bishops Stortford CM23 3AB if you do not agree with the terms below. If we do not hear from you within 21 days, we will assume you agree to the terms below. 
 

Appointment of agent

I appoint RSPCA Stort Valley Branch to act as my agent in selling goods belonging to me. I understand and agree that:

  • I own the goods that I provide to RSPCA Stort Valley Branch for sale and confirm that I obtained them lawfully.

  • I am providing the goods as a private individual and am not acting in the course of a trade or business.

  • I retain legal and beneficial ownership of the goods until they are sold.

  • I am not donating the goods themselves to RSPCA Stort Valley Branch. I am appointing RSPCA Stort Valley Branch as my agent to sell the goods on my behalf.

  • RSPCA Stort Valley Branch will attempt to sell the goods on my behalf in accordance with its normal procedures.

  • RSPCA Stort Valley Branch may determine the method, location and selling price of the goods in accordance with its normal procedures and with the aim of achieving a reasonable sale.

  • I have the right to receive the net sale proceeds from the sale of my goods, subject to the Method A arrangements set out in this agreement.

  • RSPCA Stort Valley Branch may decline to sell goods that it considers unsuitable for sale.

Commission

RSPCA Stort Valley Branch will charge a commission of 2% of the gross sale proceeds for acting as my agent. As RSPCA Stort Valley Branch is VAT registered, VAT will be charged on the commission at the applicable rate. The commission and VAT charged on the commission will be deducted from the gross sale proceeds when calculating the net sale proceeds. Any change to the commission rate will be notified to me before the new rate applies to goods subsequently provided for sale.

Goods which cannot be sold

I authorise RSPCA Stort Valley Branch to dispose of, recycle or otherwise deal with goods which, in its reasonable opinion:

  • have no reasonable saleable value;

  • cannot reasonably be sold;

  • have not sold within a reasonable period; or

  • cannot be processed through the Retail Gift Aid scheme.

I understand that such goods may not be returned to me.

Donation of Net Sale Proceeds – Method A

I agree that net sale proceeds of up to £100 in total in each tax year (6 April to 5 April) from the sale of my goods will be donated to RSPCA Stort Valley Branch. Net sale proceeds are the gross sale proceeds after deduction of the agreed commission and VAT charged on that commission. I understand that RSPCA Stort Valley Branch does not have to contact me before claiming Gift Aid on net sale proceeds where my cumulative net sale proceeds in a tax year are £100 or less. If my cumulative net sale proceeds exceed £100 in a tax year, RSPCA Stort Valley Branch will contact me and give me at least 21 days to tell the charity if I do not wish to donate the amount above £100. If I do not tell RSPCA Stort Valley Branch within that 21-day period that I wish to receive the proceeds above £100, I understand that RSPCA Stort Valley Branch will treat those proceeds as donated to the charity and, subject to the Gift Aid rules, claim Gift Aid on them. I understand that I am responsible for notifying RSPCA Stort Valley Branch if I no longer wish to donate any amount that has not yet been treated as a Gift Aid donation.

Gift Aid and Tax

I understand that Gift Aid can only be claimed on amounts that I donate to RSPCA Stort Valley Branch. I understand that the amount on which Gift Aid is claimed will be the net sale proceeds after deduction of the agreed commission and VAT charged on the commission. I understand that I must have paid sufficient UK Income Tax and/or Capital Gains Tax in the relevant tax year to cover the Gift Aid claimed on my donations. If I have not paid sufficient tax to cover the Gift Aid claimed, I understand that I may be liable to pay the difference to HM Revenue & Customs.

End-of-Tax-Year Statement

RSPCA Stort Valley Branch will provide me with a statement showing the net sale proceeds from the sale of my goods for the relevant tax year. The statement will normally be provided by 31 May following the end of the tax year. Where my total net sale proceeds for a tax year are less than £20, RSPCA Stort Valley Branch may use the Gift Aid de minimis provision. In that case, a statement does not have to be provided every year and may instead be provided at least once every three years, or sooner if my net sale proceeds reach £20 or more. I may request a statement of my net sale proceeds at any time. The statement is provided to allow me to check the amount of Gift Aid claimed and my tax position. It does not create a right to reclaim amounts that have already been donated to RSPCA Stort Valley Branch.

Retail Gift Aid Administration

RSPCA Stort Valley Branch uses Wil-U Solutions Limited as an external service provider to assist with the administration and processing of Retail Gift Aid. I understand that my personal information and information about the sale of my goods may be shared with Wil-U Solutions Limited for the purpose of administering Retail Gift Aid and processing Gift Aid claims. My information will be handled in accordance with the RSPCA Stort Valley Branch Privacy Notice.

Cancellation

I may cancel this Gift Aid declaration and/or this agency agreement at any time by notifying RSPCA Stort Valley Branch. RSPCA Stort Valley Branch may terminate this agency agreement by notifying me. Cancellation will not affect any Gift Aid claim relating to donations that were validly made before cancellation.

Agency Agreement Confirmation

If we do not hear from you within 21 days of sending you this notice, we will assume that you agree to the following:

I understand that RSPCA Stort Valley Branch is acting as my agent to sell my goods.

I understand that I am not donating the goods themselves to RSPCA Stort Valley Branch.

I understand that I retain ownership of my goods until they are sold.

I understand that I have the right to receive the net sale proceeds, subject to the Method A arrangements set out in this agreement.

I have read and understood this Agency Agreement.
